摘要：JCT合同條件不僅在英國本土得到廣泛使用，也被很多英國以外的國家和地區所認可。從合同結構、第三方合同管理者的權限、付款程序和內容、材料設備運輸中的風險分配、工程索賠、爭端解決等方面對新版JCT《標準建造合同》和FIDIC《土木工程施工合同條件》進行比較研究，發現與FIDIC合同條件相比，JCT合同條件在合同管理者對承包商人員變動的干預權方面的規定更有利于業主，而在業主對承包商選擇分包商的確定權、工程付款程序、材料設備運輸中的風險分配等方面的規定更有利于承包商。

Abstract：The JCT standard contracts are not only widely used in UK，but also widely accepted around the world. The paper makes a comparative study of the latest version of JCT Standard Construction Contract and FIDIC Civil Engineering Construction Contract conditions on the following aspects：contract structure，third party contract manager’s rights，payment procedures and content，risk allocation in the transportation of materials and equipment，claims，dispute avoidance and settlement. The study reveals that，compared with FIDIC contract conditions，JCT contract conditions are in favor of the owner in terms of right of intervention of the determination of contractor’s personnel，while in favor of the contractor in terms of selection of subcontractors，payment procedures，risk allocation in the transportation of materials and equipment，etc.
